and location of legally established buildings that were lost. Below is a comprehensive guide to
help navigate the requirements and application process for rebuilding.

Understanding Like-for-Like Replacement

A like-for-like replacement structure must adhere to the following criteria:
● Same Use: The structure must serve the same function as the original.
● Same Size: The square footage and dimensions should match the destroyed structure.
● Same Location: The new structure must be built in the same position as the lost one.

LA County provides proof of legal establishment for the damaged structures, such as building
permits, planning approvals, or historical records. In some cases, minor modifications may be
approved, but they must not exceed a 10% increase in floor area, height, or footprint.

Environmental Considerations: Oak Trees & Sensitive Areas

● Oak Tree Protection: LA County enforces strict protection laws for oak trees. An Oak
Tree Permit is required if the rebuild is within the protected zone of an oak tree, unless
the previous structure was legally established in that area before the disaster.
● Significant Ecological Areas & Grading: Additional regulations apply if your property
is within a Significant Ecological Area (SEA) or if significant grading is necessary.

● LA County Building & Safety (structural standards and code compliance)
● LA County Public Health (onsite wastewater treatment, sanitation, and water supply)
● LA County Fire Department (fire flow, emergency access, and fire-resistant materials)
Additionally, property owners must provide proof that burn debris disposal has been
completed according to LA County’s guidelines before submitting an application.

● Destroyed Structure(s) Footprint: Clearly marked location of the previous structure.
● Setbacks & Natural Features: Identify setbacks, oak trees, streams, and other notable
site features within 100 feet of the rebuild site.
● Utility Information: Document water, electricity, and waste disposal infrastructure
details.

Additional Considerations & Fees

● There may be application fees associated with processing your submission.
● If your rebuild exceeds 10% modifications, a new planning approval may be

● Properties in flood zones, earthquake-prone areas, or historic districts may require
special permits.
